1. PRIVACY
Limited Liability Company DIATON (hereinafter referred to as DIATON or DIATON LLC) undertakes to protect and respect your right to privacy.
This Regulation on the processing and protection of personal data (hereinafter referred to as the "Regulation") specifies the purposes of collecting your data and the process of processing it by DIATON LLC. You must read this Regulation and, if you disagree with the text, leave the Diamonist.ru Website.
The data you provide is confidential and is subject to disclosure by us under the circumstances set out in the Regulation and (or) provided for by the legislation of the Russian Federation.
By loading our website on your computer, mobile device or mobile application and:
• filling out web forms containing your personal data, and/or
• transferring your personal data to DIATON LLC when placing an online order on the website or in another way, you agree to the terms and conditions described in the Regulation.
DIATON LLC processes your data in accordance with the legislation of the Russian Federation. We guarantee the conscientious collection of data and the preservation of its confidentiality.

2. TERMS AND DEFINITIONS
Personal data (hereinafter referred to as "PD" or "personal data") - any information related to a directly or indirectly identified or identifiable individual (subject of PD).
Subject of PD - an individual (client/buyer, visitor to an online store) who has personal data that directly or indirectly identify him/her. In this document, this is an individual who intends to order, purchase/buy goods and subsequently use the goods exclusively for personal, family, household and other needs not related to the implementation of entrepreneurial activities.
PD Operator - OOO "DIATON" (TIN 7729725590, OGRN 1127747172585, Address: 101000, Moscow, Chaplygina St., 9, building 1).
Processing of PD – any action (operation) or set of actions (operations) performed with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
Automated processing of PD – processing of personal data using computer technology.
Non-automated processing of PD – processing of personal data with the direct participation of a person, contained in a personal data information system or extracted from such a system.
Cross-border transfer of PD – transfer of personal data to the territory of a foreign state to a government body of a foreign state, a foreign individual or a foreign legal entity.
Confidentiality of PD — a mandatory requirement for the Operator or other official working with the User's data to keep the received information secret, without disclosing it to outsiders, if the User who provided the personal data has not expressed his consent, and there is no legal basis for disclosure.
Online store website - https://diamonist.ru (hereinafter referred to as the Website or Online store).
Website user - a person who has visited the website of the Online store, as well as using its programs and products.
Cookies — a short fragment of data sent by a web browser or web client to a web server in an HTTP request whenever the User tries to open a page of the Online store. The fragment is stored on the User's computer.
IP address — a unique network address of a node in a computer network built using the TCP/IP protocol.

3. GENERAL PROVISIONS
3.1 These Regulations have been developed in accordance with the Federal Law of the Russian Federation dated 27.07.2006 No. 152-FZ "On Personal Data" and other acts of the Russian Federation. The Regulations define the procedure and conditions for processing PD by the PD operator company, DIATON LLC, and establish the procedure for working with PD, the rules for protecting PD, and define the rights, duties, and responsibilities of the heads of structural divisions and employees of the PD operator company, DIATON LLC.
3.2 The objectives of these Regulations are:
• defining the procedure for processing PD;
• ensuring that the procedure for processing PD in DIATON LLC complies with the Russian Federation legislation in the field of PD;
• ensuring the protection of PD.
3.3 The tasks of these Regulations are:
• defining the principles of processing PD;
• defining the conditions for processing PD, methods of protecting PD;
• defining the rights of PD subjects, the rights and responsibilities of DIATON LLC when processing PD.
3.4 These Regulations have been developed taking into account the requirements of the following regulatory acts:
• Constitution of the Russian Federation;
• Federal Law of the Russian Federation of 27.07.2006 No. 149-FZ "On Information, Information Technologies and Information Protection";
• Federal Law of the Russian Federation of 27.07.2006 No. 152-FZ "On Personal Data";
• Resolution of the Government of the Russian Federation of 01.11.2012 No. 1119 "On Approval of Requirements for the Protection of Personal Data When Processing Them in Personal Data Information Systems";
• Resolution of the Government of the Russian Federation of 15.09.2008 No. 687 "On Approval of the Regulation on the Peculiarities of Processing Personal Data Carried Out Without the Use of Automation Tools";
• Order of the FSTEC of Russia dated 18.02.2013 No. 21 "On approval of the Composition and content of organizational and technical measures to ensure the security of personal data when processing them in personal data information systems";
• Order of the FSTEC of Russia dated 14.05.2020 No. 68 "On amendments to the Composition and content of organizational and technical measures to ensure the security of personal data when processing them in personal data information systems, approved by the order of the Federal Service for Technical and Export Control dated February 18, 2013 No. 21";
• other acts applicable in the territory of the Russian Federation
3.5 This Regulation applies to the processes of processing personal data in DIATON LLC using automation tools, including using information and telecommunication networks, and without using such tools.
3.6 The existing Privacy Policy applies only to the website of the Online Store. If the User accesses third-party resources via links posted on the latter's website, the Online Store shall not be held liable for his/her actions.
3.7 DIATON LLC ensures the recording, systematization, accumulation, storage, clarification (updating, modification), and extraction of personal data of citizens of the Russian Federation using databases located on the territory of the Russian Federation.
3.8 These Regulations shall enter into force upon their approval by the General Director of DIATON LLC and shall be valid indefinitely until they are replaced by a new regulation (new version of the Regulations).
3.9 DIATON LLC shall review these Regulations and update them as necessary, in particular:
• when the procedure for processing personal data in DIATON LLC changes;
• based on the results of inspections by the body for the protection of the rights of personal data subjects that revealed discrepancies with the requirements of the Russian Federation legislation on ensuring the security of personal data;
• when the requirements of the Russian Federation legislation in the field of personal data for the procedure for processing and ensuring the security of personal data change;
• in case of detection of significant violations based on the results of internal audits of the personal data protection system;
3.10 When making changes to this Regulation, the date of the last update is indicated. The new version is put into effect by order of the General Director of DIATON LLC.
If you continue to interact with DIATON LLC in any way, in particular (but not limited to) through the Site or by personally contacting the office of DIATON LLC, you agree with the version of the Regulation in effect at that time, including providing consent to the processing of your data in accordance with Section 7 of the Regulation.

4. COLLECTION AND SUBSEQUENT USE OF PERSONAL DATA. LIST AND PURPOSES OF PROCESSING
4.1 We may request your personal data and, at your discretion, provide it to us for the purpose of selling goods and fulfilling our obligations when processing your orders, including, but not limited to, the following cases:
• Sale of DIATON goods and provision of related services, including delivery of goods, ensuring the return of DIATON goods or consideration of a claim regarding purchased DIATON goods and (or) services, as well as the implementation of other rights and obligations of the PD operator as a seller and the subject of PD as a buyer;
• Consultations and any other communication in any form on issues related to the activities of DIATON LLC;
• Identification of the User who has completed the registration procedure on the website of the Online Store in order to place an order and (or) purchase goods from this store remotely.
• Providing the User with access to the personalized resources of this site.
• Establishing feedback with the User, which means, in particular, sending requests and notifications regarding the use of the website of the Online Store, processing user requests and applications, and providing other services.
• Determining the location of the User in order to ensure payment security and prevent fraud.
• Creating an account to make Purchases, if the User has expressed their desire to do so.
• Sending a notification to the User about the status of their order in the Online Store.
• Processing and receiving payments, confirming taxes or tax benefits, disputing payments, determining the advisability of providing a specific User with a credit line.
• Informing about updated products, unique offers, new prices, news about the activities of the Online Store or its partners, and other information related to the activities of DIATON LLC.
• Advertising goods/services of the Online Store.
• Providing the User with access to the websites or services of the Online Store, thereby helping them to receive products, updates, and services.
4.2 The personal data you provide may be used by DIATON LLC to promote goods, works, services using various means of communication (e-mail, text messages, push notifications, calls, etc.), including, but not limited to, the following cases:
• Participation in competitions, promotions, events, surveys, research conducted by DIATON LLC and (or) or on behalf of the company;
• Sale of DIATON goods and provision of related services, including delivery of goods, ensuring the return of goods or consideration of a claim regarding purchased DIATON goods and (or) services, as well as the implementation of other rights and obligations of the PD operator as a seller and the subject of PD as a buyer;
• Consultations and any other communication in any form on issues related to the activities of DIATON LLC;
• In other cases, during interaction between you and DIATON LLC.
4.3 The following data may be requested by us and, at your discretion, provided:
• Last name, First name, Middle name (if any), date of birth, gender;
• Residential address or delivery address of the purchased goods;
• Contact details (phone, email address);
• Details of the main identity document;
• Financial information, including the credit or debit card number (only the last four digits of the card number), or other payment information;
• History of your purchase of DIATON products and related services;
• History of requests to DIATON LLC and interactions with DIATON LLC;
• Your interests and preferences in the field of fashion, jewelry, style, etc.;
• Other data at your discretion and the discretion of DIATON LLC.
4.4 By providing your PD, you agree to receive advertising information from DIATON LLC (Diamonist, DIATON), which we can provide/send by telephone, via text and/or graphic messages, by e-mail (e-mail newsletter) and in other ways that do not contradict the Russian Federation legislation regulating the advertising activities of companies. You can refuse to receive advertising information at any time by notifying DIATON LLC by telephone/e-mail/via the Site.

5. PROCESSING OF TECHNICAL INFORMATION NOT RELATED TO PERSONAL DATA
5.1 In order to improve our Site and ensure the best possible presentation of content to you on your computer or mobile device, as well as to provide you with the ability to quickly and easily navigate our Site, we process data such as IP address, information about your browser and operating system, data from cookies and other similar information that does not contain personal data.
5.2 Such data is transmitted by your device from which you open our site automatically and is used by us exclusively for statistical purposes, to analyze ways to improve the quality of service, DIATON products and related services.
5.3. Disabling cookies may result in the inability to access parts of the Online Store website that require authorization.
5.4. DIATON LLC collects statistics on the IP addresses of all visitors. This information is needed to identify and resolve technical problems and to control how legal the financial payments will be.
Any other personal information not specified above (about when and what purchases were made, what browser was used, what operating system was installed, etc.) is securely stored and is not distributed/transferred to third parties.

6. IN WHAT CASES DO WE HAVE THE RIGHT TO DISCLOSE THE PERSONAL DATA PROVIDED TO US TO THIRD PARTIES
6.1. We may disclose your personal data to our employees and trusted partners of DIATON LLC, who will process them on behalf of DIATON LLC exclusively for the purposes stated in this Policy.
6.2. Personal data may be transferred to third parties, including courier services, postal organizations, and telecommunications operators. This is done in order to fulfill the User's order left by him on the website of the Online Store and deliver the goods to the address. The User's consent to such transfer is provided for by the rules of the website policy.
6.3. We make every effort to ensure the protection of your personal data when providing it outside of DIATON LLC and guarantee the availability of processes for its protection. All third parties processing personal data on behalf of DIATON LLC guarantee compliance with all applicable norms and standards in the territory of the Russian Federation.
6.4. Personal data may be transferred to authorized bodies of state power of the Russian Federation, if this is carried out on legal grounds and in the manner prescribed by Russian legislation.

7. CONSENT TO THE PROCESSING OF PERSONAL DATA
7.1 You, as the subject of personal data, hereby give consent to DIATON LLC, located at the address specified in Section 2 of this Regulation, to process your personal data, the list of which is specified in paragraph 4.3 of the Regulation, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), with the exception of cross-border data transfer (cross-border data transfer is not carried out by PoisonDrop) taking into account the current legislation of the Russian Federation, depersonalization, blocking, deletion, destruction of personal data, with and without the use of automation tools, for the purposes specified in paragraphs 4.1. and 4.2. of this Regulation.
You agree that in addition to DIATON LLC, third parties with whom DIATON LLC has contractual relations have access to your personal data in full accordance with Section 6 of the Regulation, while DIATON LLC guarantees the observance of the following of your rights:
• the right to receive information about which of your personal data are stored by DIATON LLC;
• the right to delete, clarify or correct your personal data stored by DIATON LLC;
• other rights established by the current legislation of the Russian Federation.
7.2 The consent to the processing of your personal data provided by you in accordance with this Regulation is valid until DIATON LLC achieves the corresponding purpose of their processing for 20 years from the date of receipt or until the moment of your withdrawal of the said consent to the terms of paragraph 7.3 of the Regulation.
7.3 The consent to the processing of your personal data provided by you in accordance with this Regulation may be withdrawn by you at any time. In this case, DIATON LLC is obliged to stop processing your personal data or ensure that such processing is stopped (if the personal data is processed by a third party acting on behalf of DIATON LLC) and, if the storage of personal data is no longer required for the purposes of processing personal data, to destroy the personal data or ensure that it is destroyed (if the personal data is processed by a third party acting on behalf of DIATON LLC) within the period established by the legislation of the Russian Federation, or if DIATON LLC does not have the right to process personal data without your consent on the grounds stipulated by the legislation of the Russian Federation.
You can send DIATON LLC a revocation of your previously provided consent to the processing of your personal data in one of the following ways:
• By personally contacting DIATON LLC or by sending a corresponding application by mail to the address: 101000, Moscow, Chaplygina St., 9, building 1;
• By sending a corresponding application to the email address: hello@diamonist.ru
In a number of cases provided for in paragraphs 2-11 of Part 1 of Article 6 of the Federal Law “On Personal Data”, DIATON LLC may continue to process your personal data after the withdrawal of your consent.

8. WHERE AND HOW WE STORE YOUR DATA
DIATON LLC guarantees that the data received from you is stored in a secure environment.
This means that your data is protected from unauthorized access, disclosure, use, modification or destruction by both organizations and individuals. This is ensured by the presence of appropriate technical administrative and practical security measures.

9. TELEPHONE CALLS
Calls to DIATON LLC may be recorded. This is done for the purposes of processing your data stated in paragraph 4.1 of this Policy. By calling DIATON LLC and continuing the conversation with an employee, you agree to the processing of the data you provide under the terms of this Policy.

10. UPDATING RECORDS
Checking the accuracy of the personal data you provide within the framework of this Policy is not the responsibility of DIATON LLC. If you discover an inaccuracy in your personal data or the need to update it (for example, you have changed your name, address, etc.), please contact us so that we can change it.
DIATON LLC is obliged to make the necessary changes to your data within the time period established by the legislation of the Russian Federation.
You can send DIATON LLC a request to make changes to your personal data in one of the following ways:

11. ACCESS TO INFORMATION
If you want to know what personal data of yours is processed by DIATON LLC, we will provide you with this information within the time period established by the legislation of the Russian Federation.
To obtain such information, you can contact DIATON LLC in one of the following ways, provided that you meet the requirements stipulated by Part 3 of Article 14 of the Federal Law of the Russian Federation of July 27, 2006 No. 152-FZ "On Personal Data"
• By personally submitting a corresponding application or by sending a corresponding application by mail to the address: 101000, Moscow, Chaplygina St., 9, building 1 to DIATON LLC;
• By sending a corresponding application in the form of an electronic document signed with an electronic signature in accordance with the legislation of the Russian Federation, to the email address .
In this case, your request must contain:
• The number of the main document certifying your identity, information about the date of issue of this document and the body that issued it;
• Information confirming the fact of personal data processing by the operator;
• Your signature (in case of an electronic application – an electronic signature).

13. WHAT CHANGES CAN DIATON MAKE TO THE REGULATION

The effective date of the new version of the Regulation is the date indicated in the upper left corner of the first page of the document. If you continue to interact with DIATON LLC in any way, in particular (but not limited to) through the Site, you agree to the current version of the Regulation.
